CSCS Age Discrimination: Deadline for Claims

PCS is taking forward members’ cases that challenge the legality of the capping and tapering provisions of the Civil Service Compensation Scheme.

In January 2020, PCS launched legal action against the government over the capping and tapering provisions affecting redundancy payments under the Civil Service Compensation Scheme (CSCS).

Our legal action asserts that the current capping and tapering arrangements treat workers less favourably due to age. We will argue that even if it is found that the government’s stated aim of operating these arrangements is deemed legitimate - that younger employees who have not reached pensionable age require a greater financial cushion – that the means of achieving it are not proportionate.

Members aged over 58 and 9 months or older and who have, or are about to leave, employment with a compensation payment for early severance, voluntary or compulsory redundancy, are potentially eligible to bring a claim. The deadline for submission of cases is Monday 8 November 2021.

An eight day preliminary hearing involving almost 300 PCS members has been listed by the Employment Tribunal beginning on 6 December 2021. It has been agreed that six test claimants will be heard by the Employment Tribunal and all other claims will remain stayed behind these.
