Specialist pay proposal for interim arrangement for legal advisers

PCS has met with the HMCTS pay team to discuss specialist pay. The meeting focussed on Saturday and bank holiday ‘occasional’ courts and legal adviser pay. HMCTS has advised that the proposal outlined to PCS is an interim arrangement. 

The interim arrangement will last until such a time that the full specialist pay review has concluded.

Only HEO (Band C) and SEO (Band B) legal advisers are eligible. The overtime rates have all been agreed as part of the wider pay deal. Legal advisers at band B will receive a 1.25x rate for weekend and bank holiday courts only, other overtime will be paid at the usual rate.

The proposal is for a legal adviser Saturday and bank holiday ‘occasional’ courts incentive scheme.

Those who chose to participate in the scheme will volunteer for and work a number of occasional courts within a 6-monthly rota and will be eligible for the £50 bonus per day worked.

Under the proposed scheme overtime rates, guaranteed at a minimum of 6 hours overtime, will still be paid at the appropriate overtime rates. The standby/call out allowances will remain unchanged and will still be paid at £52 or £26.

Before PCS can proceed any further in negotiations with the employer, we are consulting legal adviser members on the detail of the proposal. 45 minutes paid time off has been agreed for legal adviser members to attend one of the following meetings being held via Teams.
