Specialist pay proposal for interim arrangement for legal advisers update

Following the legal adviser members' meetings held last week PCS met with HMCTS representatives again to discuss the concerns raised. HMCTS listened to the concerns we raised and has now written to us with an improved interim arrangement proposal.

The proposal for a legal adviser Saturday and bank holiday ‘occasional’ courts incentive scheme stands. However, rather than a £50 bonus for courts worked voluntarily on a 6-month rota; an improved bonus of £70 is now proposed. In addition, we now have confirmation that there will be no limit on the number of courts Legal advisors need to volunteer for in order to be eligible for the scheme payment.

Members understandably raised their frustrations over being expected to wait 6 months for the payment for occasional courts covered. HMCTS has now agreed to make the payments on a 3 monthly basis.

Under the proposed scheme overtime rates, guaranteed at a minimum of 6 hours overtime, will still be paid at the appropriate overtime rates. The standby/call out allowances will remain unchanged and will still be paid at £52 or £26.

HMCTS has confirmed their intention to implement on the 1 October 2021.

PCS will be organising a further meeting for legal adviser members to discuss this improved proposal.
